Terms of Service

1. Agreement Acceptance

By engaging MBVELO IT (Pty) Ltd for professional IT services, you agree to these terms. Our services include web design, SEO, hosting, cloud solutions, and IT consulting.

2. Services Provided

• Web Design & Development: Custom websites, e-commerce solutions
• SEO Services: Search engine optimization and digital marketing
• Hosting & Cloud: Web hosting and cloud infrastructure solutions
• IT Consulting: Enterprise IT strategy and implementation
• Support & Maintenance: Ongoing technical support services

3. Payment Terms

• Quotes: All quotes valid for 30 days unless otherwise specified
• Payment: 50% deposit required to commence work, balance due on completion
• Recurring Services: Hosting and SEO services billed monthly in advance
• Late Payments: Interest may apply on overdue accounts
• Refunds: Work completed cannot be refunded, deposits refundable before work commences

4. Project Delivery

• Timelines: Delivery estimates provided in writing, subject to client feedback cycles
• Revisions: Standard packages include 3 rounds of revisions
• Client Responsibilities: Timely provision of content, feedback, and approvals
• Delays: Client-caused delays may affect delivery timelines and costs

5. Intellectual Property

• Custom Work: Full rights transfer to client upon final payment
• Templates: Template-based work includes usage rights, not ownership
• Third-Party Content: Client responsible for licensing of stock photos, fonts
• Code Libraries: Open-source components remain under original licenses

6. Hosting & Domain Services

• Uptime: 99.9% uptime guarantee with SLA compensation
• Backups: Daily backups maintained for 30 days
• Domain Registration: Domains registered in client's name
• Data Portability: Full data export available upon request

7. SEO & Marketing Services

• Results: SEO results not guaranteed, best practices followed
• Reporting: Monthly performance reports provided
• Compliance: All work complies with search engine guidelines
• Campaign Management: Ad spend separate from management fees

8. Data Protection & Security

• POPIA Compliance: All services comply with South African data protection laws
• GDPR Ready: Services configured for GDPR compliance where applicable
• Security: Industry-standard security measures implemented
• Confidentiality: Client data treated as strictly confidential

9. Service Level Agreements

• Support Response: Business hours support within 4 hours
• Emergency Support: Critical issues addressed within 2 hours
• Maintenance Windows: Scheduled maintenance communicated 48 hours in advance
• Performance Monitoring: Continuous monitoring of hosted services

10. Limitations & Liability

• Service Limits: Fair usage policies apply to hosting and support
• Liability Cap: Total liability limited to fees paid in preceding 12 months
• Force Majeure: Not liable for delays due to circumstances beyond our control
• Third-Party Services: Not responsible for third-party service disruptions

11. Termination

• Client Termination: 30 days written notice for ongoing services
• Our Termination: Right to terminate for non-payment or breach
• Data Retention: Client data maintained for 30 days post-termination
• Final Billing: Pro-rated billing for partial months

12. Governing Law

These terms are governed by South African law. Any disputes will be subject to the jurisdiction of South African courts.
